Early life and education
Stewart was a private practice attorney in Utah from 1974 to 1980. In 1980, Stewart moved to Washington, DC and served as a Staff Assistant to U.S. Senator Orrin Hatch in 1980 and also served as a Staff Assistant to Congressman James Hansen of Utah from 1981 to 1985. From 1985 to 1992, Stewart served as Commissioner of the Utah Public Service Commission. Stewart was the Executive Director of the Utah Department of Commerce in 1992, and the Executive Director of the Utah Department of Natural Resources from 1993 to 1998. From 1998 to 1999, Stewart served as Chief of Staff to former Utah Governor Mike Leavitt. In 1997, Stewart was also a visiting Professor at Weber State University.

Stewart was nominated to the United States District Court for the District of Utah by President Bill Clinton on July 27, 1999, to a seat vacated by Thomas Greene. Stewart was confirmed by the U.S. Senate on October 5, 1999, and received his commission on November 11, 1999.
