The Cherokee County Magistrate Court is a court of limited jurisdiction. It operates 24 hours per day, 365 days per year to respond to law enforcement requests for criminal arrest and search warrants, in addition to its normal case load managed during each work week. The Court’s major responsibilities are:

Criminal Jurisdiction

  • Issue arrest warrants and search warrants.
  • Hold first appearance hearings to ensure defendants are held on proper arrest warrants and to set bond in most cases.
  • Hold preliminary commitment hearings to determine whether probable cause for arrest exists in criminal cases.
  • Hear civilian arrest warrant applications.
  • Hear criminal bad check cases.
  • Hear county criminal ordinance violation cases.

Civil Jurisdiction

  • Hear small claims trials for cases where the amount in controversy does not exceed $15,000.
  • Hear dispossessory (i.e., eviction) cases.
  • Hear judgment collection matters involving garnishment of wages and bank accounts, foreclosing on abandoned vehicles and vessels, and post-judgment discovery matters.
  • Perform wedding ceremonies.[1]

Hours: 8:30 a.m. – 5:00 p.m. Monday through Friday

Marriage Ceremonies are performed at no cost every Monday morning at 8:30 a.m. Couples must arrive with marriage license in hand not later than 8:20 a.m. Late arrivals will have to wait until the following week.
