Neary received a bachelor's degree in German in 1981 from Westmar College and his law degree in 1987 from the University of South Dakota. He served in the U.S. Army Reserves, Judge Advocate Corps and was honorably discharged in 1999.
Neary has worked as an assistant Woodbury County attorney and a private practice lawyer in both Sioux City and Le Mars, Iowa. During the mid 1990s, he worked part-time as a Plymouth County magistrate. He was also an assistant federal public defender in the Northern District of Iowa until his judicial appointment in 2002.
