Sean H. Lane is a federal bankruptcy judge for the Southern District of New York bankruptcy court. He was appointed to the court on September 7, 2010.[1]

Education

Lane received his undergraduate and J.D. degrees from New York University.[2]

Career

Prior to joining the court, Lane served in the District Attorney's Office for the Southern District of New York. He began his legal career as a law clerk for Judge Edmund Ludwig, then Judge Charles Richey.[2]

Notable cases

American Airlines/US Airways merger (2013)

     United States bankruptcy court, Southern District of New York (Re: AMR Corporation, et al., 11-15463)

In a ruling from April 2013, Judge Lane approved the merger plan for American Airlines (parent company AMR) and US Airways, though the deal was still under the review of the U.S. antitrust regulation. Part of that merger was a severance package for CEO Doug Parker, who would receive $19.9 million dollars (in cash and stock) after serving as CEO for the months following the merger. Judge Lane ruled that Parker's severance package was not allowed under a regulation that severance payments cannot extend ten times the amount offered to non-management employees.[3]


Update

In August 2013, Judge Lane declined the merger that would have allowed AMR Corporation's exit from bankruptcy, based on the antitrust lawsuit filed by the United States Department of Justice. In response to the federal lawsuit, Judge Lane asked both parties to submit briefs as to why he should still approve the action.[4]
