Early life and education
Born in Roanoke, Virginia, Agee graduated from Bridgewater with his bachelor's degree in 1974 and later from Virginia Law with his Juris Doctor degree in 1977. Agee obtained a Masters of Laws degree from New York University School of Law in 1978. Agee served in the United States Army Reserve from 1986 to 1997.
Agee was a private practice attorney in Virginia from 1977 to 2000. From 1982 to 1994, Agee served as a elected member of the Virginia House of Delegates. Agee was a State Appeals Judge for the Court of Appeals of Virginia from 2001 to 2003 and was later elected by the People of Virginia as Justice of the Supreme Court of Virginia in 2003.
On the recommendation of Virginia U.S. Senator John Warner, Agee was nominated to the United States Court of Appeals for the Fourth Circuit on March 13, 2008 by President George W. Bush to replace Michael Luttig. Agee was confirmed by the Senate on May 20, 2008 on a Senate vote and received commission on July 1, 2008.
