Banner County is located within the district court 12th Judicial District and the county court 12th Judicial District.

The people of Banner County are served by a District Court, a County Court and a Problem-Solving Court.

The United States District Court for the District of Nebraska has jurisdiction in Banner County. Appeals from the District of Nebraska go to the United States Court of Appeals for the Eighth Circuit.
