The Courts in Montana includes the state court system and two federal courts.
State courts
Appellate courts
The Montana Supreme Court is the highest court in the State and the only appellate court, so it resolves all appeals from the lower courts. It has original jurisdiction, so it can also accept other cases.[1][2]
Trial courts
There are 56 District Courts in Montana which are organized into 22 judicial districts. According to Montana's State website, the District Courts:
- "process all felony cases, all probate cases, most civil cases at law and in equity, certain special actions and proceedings, all civil actions that may result in a finding against the state for the payment of money, naturalization proceedings, various writs, and some narrowly-defined ballot issues."
They also may hear certain appeals from the lower Courts of Limited Jurisdiction.[3]
Other courts
- Montana's court system also includes Courts of Limited Jurisdiction. This includes 66 Justice Courts, 81 City Courts and 5 Municipal Courts.[4]
- There is also a Water Court[5] and a Workers' Compensation Court[6].
Federal courts
There are two federal courts in Montana: the District of Montana and the District of Montana Bankruptcy Court[7].
Appeals from these courts go to the 9th Circuit Court of Appeals.
