Courts in New Mexico

The Courts in New Mexico consist of the state court system and two federal courts.
State courts
The New Mexico State Court System is made up of the:
- Supreme Court
- Court of Appeals
- District Courts
- Magistrate Courts
- Bernalillo County Metropolitan Court
- Municipal Courts
- Probate Courts
- Problem-Solving Courts
Appellate courts
The Supreme Court[1] is the court of last resort. The Court of Appeals[2] is the State's intermediate appellate court.[3]
Trial courts
- The District Courts are organized into 13 judicial districts. They are courts of general jurisdiction and hold jury trials.[3]
- There are 54 Magistrate Courts in New Mexico. These courts have limited jurisdiction and hold jury trials.[3][4]
- In Bernalillo County, there is a special Bernalillo County Metropolitan Court which is similar to the Magistrate Courts.[3][5]
Other courts
- There are 80 Municipal Courts in New Mexico which hear cases about traffic and city ordinance violations, petty misdemeanors and DWI/DUI. These courts have limited jurisdiction and do not hold jury trials.[3]
- There is one probate judge in each of the State's 33 counties. The Probate Courts have limited jurisdiction and do not hold jury trials.[3]
- There are also Problem-Solving Courts which are "treatment-based alternatives to prison".[6]
Federal courts
There are two federal courts in New Mexico: the District of New Mexico[7] and the District of New Mexico Bankruptcy Court[8].
Appeals go to the 10th Circuit Court of Appeals.
