Courts in West Virginia
The Courts in West Virginia consist of a state court system and four federal courts.
Appellate Court
Supreme Court of Appeals of West Virginia
The Supreme Court of Appeals is the court of last resort and the only appellate court in West Virginia. It can grant or refuse review of any appellate cases. [1]
Trial Court
The Circuit Courts are main trial courts in West Virginia. They have jurisdiction over most civil and criminal cases and they hear appeals from the lower courts. There are 31 judicial circuits and 65 circuit judges.[1]
There are twenty-six Family Court circuits and 35 Family Court judges in West Virginia. These judges hear cases about divorce, child custody, domestic violence, etc.[1]
West Virginia Magistrate Courts
The Magistrate Courts are trial courts of limited jurisdiction. There are 158 magistrates in West Virginia. They issue warrants and protective orders, hear misdemeanor cases, hear minor civil cases, and conduct some preliminary reviews.[1]
West Virginia Municipal Courts
The Municipal Courts are locally administered and hear cases regarding ordinance violations.[1]
Federal courts
There are four federal courts in West Virginia:
- Northern District of West Virginia
- Southern District of West Virginia
- Northern District of West Virginia, bankruptcy court
- Southern District of West Virginia, bankruptcy court[2]
Appeals go to the United States Court of Appeals for the Fourth Circuit.
