Donn Kessler

Donn Kessler is a judge on the Arizona Court of Appeals, Division One. He was appointed to the bench by Democratic Governor Janet Napolitano in 2003. [1] He was retained to the court in 2006 and his current term expires in 2012.

Biography

Judge Kessler received his B.A. from the University of Virginia in 1972, and his JD from Yale Law School in 1975. [2]

Legal experience

Kessler, 58, served as partner in the law firm of Jones, Skelton & Hochuli until his judicial appointment. [1] He also served as Deputy Attorney General for the State of Hawaii (1975-1977) and an Assistant Attorney General for the Commonwealth of Virginia.

Retention election

Judge Kessler was subject to a retention election in 2006.

  • 133,169 voted not to retain. [3]

Rulings

Donn Kessler wrote an opinion about the courts unanimous decision against the "Colorado City Eight," specifically why Kelly Fischer was not allowed to take an underage bride as a "celestial wife." According to Kessler's opinion Fisher's case was rejected due to the bride's age and the state statute outlawing polygamy.[4]
