The Erie County Family Court is one of several other trial courts in Erie County, New York. The court is located within the 8th Judicial District.

Jurisdiction

The Family court has original jurisdiction over:

• Protection of minors
• Custody of minors, except for custody incidental to marriage and separation
• Adoption
• Support of dependents except for support incidental to marriage and separation
• Establishment of paternity
• Spousal conciliation
• Guardianship of minors

The court also has jurisdiction over habeas corpus proceedings regarding the custody of minors, marital separation, annulment and divorce proceedings, and applications to enforce or modify custody or support rulings when referred by the Supreme Court of New York.
