Idaho Supreme Court to decide on Canyon County open records case
NAMPA, Idaho: The Idaho Supreme Court is set to hear Bob Henry's appeal of a lower court decision that said that Canyon County does not have to make public the terms of its contract with former Canyon County Prosecuting Attorney John Bujak.
Bujak, while serving as the county's prosecuting attorney, entered into an agreement with the City of Nampa to work through some of the city's legal caseload. That contract has led to a legal battle and a criminal investigation.
Henry's interest is in making the contract, under which hundreds of thousands of dollars of public money was spent, open to the public. After Henry filed requests for the records in March-April 2010, a district court judge said that the documents should not be made public because the contract was private.
Bujak resigned his position on October 1, 2010, and subsequently filed for bankruptcy. County officials have said that Bujak owes the county about $300,000 for expenses he incurred in his legal work on behalf of the City of Nampa.
