A Texas native, Payne graduated from University of Oklahoma with his Bachelor's Degree in 1963 and his Juris Doctor degree in 1966. [1]

Judicial career
Eastern District of Oklahoma, Magistrate
Payne was appointed by former Chief, now Senior Judge Frank Seay, in 1988 as a federal magistrate judge for the Eastern District of Oklahoma. Payne served in this role until 2001.
Eastern, Northern, Western Districts of Oklahoma
On September 4, 2001 on the recommendation of Senators James Inhofe and Don Nickles, Payne was nominated by President George W. Bush as a federal judge for the Districts of Eastern, Western, and Northern Oklahoma. He was confirmed by the Senate on October 23, 2001, and received commission on October 24, 2001. He is primarily a judge for the Eastern District of Oklahoma and has served as the chief judge of that court since 2002. [1]
