Notable cases

Out-of-state petitions signers ruling

*Citizens in Charge v. Gale No. 4:09CV3255
In 2011, a debate erupted about petitions urging people to recall Omaha Mayor Jim Suttle. Some in the debate said it was too easy to get all the signatures needed and others said it was too hard. The Nebraska law that deals with citizen-based ballot issues ranging from recalls to referendums was under Judge Bataillon's review. Judge Bataillon ruled that people from other states can now come into Nebraska and circulate petitions. In the case of Citizens in Charge v. Nebraska Secretary of State John Gale, Bataillon ruled unconstitutional the law that said only Nebraska citizens of at least eighteen years can circulate petitions.[3]
