Joseph F. Bataillon is an Article III federal judge for the United States District Court for the District of Nebraska. He joined the court in 1997 after being nominated by President Bill Clinton. Bataillon served as the Chief Judge of the Court from 2004 - 2011.
Early life and education
A native of Nebraska, Bataillon graduated from Creighton University in Omaha with both his Bachelor's and Juris Doctor Degrees in 1971 and 1974. [1]
Professional career
Bataillon served his entire pre-judicial legal career as a practicing attorney. Bataillon started as a Deputy public defender for indingent clients in Douglas County, Nebraska's largest county from 1974 to 1980 before entering into private practice in Nebraska from 1980 to 1997. [1]
Judicial career
District of Nebraska
On the recommendation of Senator Bob Kerrey, Bataillon was nominated by President Bill Clinton on January 7, 1997 to a seat vacated by Lyle Strom as Strom went on senior status. Bataillion was confirmed by the U.S. Senate on September 11, 1997 on a unanimous consent of the Senate and received commission on September 18, 1997. [1][2]

| In 2011, a debate erupted about petitions urging people to recall Omaha Mayor Jim Suttle. Some in the debate said it was too easy to get all the signatures needed and others said it was too hard. The Nebraska law that deals with citizen-based ballot issues ranging from recalls to referendums was under Judge Bataillon's review. Judge Bataillon ruled that people from other states can now come into Nebraska and circulate petitions. In the case of Citizens in Charge v. Nebraska Secretary of State John Gale, Bataillon ruled unconstitutional the law that said only Nebraska citizens of at least eighteen years can circulate petitions.[3] |
