House Joint Resolution 1041 [1] proposes a constitutional amendment to be sent to a vote of the people, amending Articles 7 and 7B, relating to the Judicial branch and the selection of Justices and Judges, requiring Senate confirmation of any gubernatorial appointment of a judge to an intermediate appellate court, the Workers’ Compensation Court, to fill a vacancy for a district or associate district judge, and of any judicial office filled with nominees from the Judicial Nominating Commission.
The measure passed the House on a 62-36 vote. [2] Paul Sund, a spokesman for Gov. Brad Henry, spoke out against the measure, "This legislation would essentially do away with Oklahoma's nonpartisan judicial appointment process and replace it with the highly politicized Washington, D.C. process," Sund said. "The Oklahoma system has worked well; the Washington, D.C. system has not." [3]
Supporters say that Senate confirmation of judges would enhance accountability and imitate the method of confirmations at the federal level. [3]
