Supreme Court
Justices of the Idaho Supreme Court participate in non-partisan elections. If a candidate in the primary election does not win a majority of the vote, the top two candidates receiving the most votes must compete in a runoff election in the general election.[1]
If a vacancy on the court occurs, gubernatorial appointment is required. The new judge holds office for the remainder of the unexpired term. [1]
The chief justice of the court serves a four year term and is elected by the other justices.[1]
In order to join the court, an individual must meet the following qualifications: [1]
- be 30 years of age;
- be an U.S. citizen;
- be a state resident of Idaho at least 2 years;
- have had 10 years practice of law in Idaho.
Court of Appeals
All aspects of the Idaho Court of Appeals are the same as the Idaho Supreme Court, excluding the chief justice being elected to a two year term and chosen by a previous justice.[1]
District Court
All aspects of the Idaho District Courts are the same as the Idaho Supreme Court, excluding the chief justice being elected to a three year term, and district judges serving a four year term.[1]
The qualifications are as follows:[1]
- be 30 years of age;
- be an U.S. citizen;
- be a state resident 2 years in Idaho;
- be a resident of the judicial district 1 year;
- have had 10 years practice of law.
