Judicial selection in North Dakota is determined in part by the North Dakota Judicial Nominating Committee.[1]
Supreme Court
Justices of the North Dakota Supreme Court are elected to 10 year terms in a nonpartisan election. The two candidates who receive the most number of votes in the primary election, go on to run in the general election. This is provided that each candidate receives at the very least as many votes as the number of signatures there are required to be placed on the primary ballot.[1]
If a vacancy on the court occurs, gubernatorial appointment from nominating commission is required.[1]
The chief justice of the court serves a five year term and is selected by judges of the supreme court and the district courts.[1]
In order to join the court, an individual must meet the following qualifications:[1]
- be an U.S. and state citizen;
- be a licensed attorney
Court of Appeals
Cases assigned to the North Dakota Court of Appeals by the North Dakota Supreme Court are heard by series of three-judge panels. Justices on the North Dakota Court of Appeals are chosen from among active and retired district judges, retired supreme court justices, and attorneys. [1]
District Court
All aspects of the North Dakota District Courts are the same as the North Dakota Supreme Court, excluding the chief justice being elected to a three year term, and district judges serving a six year term.[1]
