North Dakota's five state supreme court justices are elected in non-partisan statewide elections to ten years terms on the court.

Interim vacancies on the court are filled by gubernatorial appointment from a nominating commission. Any interim justices so appointed must stand for election at the next general election after having served as an interim justice for at least two years.ref>Judicial selection in North Dakota</ref>
