Partial birth abortion ban upheld

Virginia: The United States Court of Appeals for the Fourth Circuit issued a 6-5 ruling to uphold Virginia's strict ban on partial birth abortion on June 25, 2009. The Virginia ban is similar to the federal ban on partial birth abortion.
The decision followed a previous ruling from a three-judge panel of the Fourth Circuit which struck down the law as unconstitutional. Former Virginia Attorney General and 2009 gubernatorial Bob McDonnell requested a re-hearing by all the active judges on the court. [1].
