The South Carolina Court of Appeals is the intermediate appellate court in South Carolina.

The Court of Appeals was established in 1983. It consists of a Chief Judge and eight associate judges who are elected by the General Assembly to staggered terms of six years each.

The Court sits either as three panels of three judges each or as a whole, and it may hear oral arguments and motions in any county of the state. [1]

2009 vacancy

When Justice John Waller of the South Carolina Supreme Court retired in 2009, Chief Judge of the South Carolina Court of Appeals Kaye Hearn was elected to replace him. Her exit from the Court of Appeals left the position of Chief Judge open for the state Legislature to fill via appointment. The South Carolina Judicial Merit Selection Commission nominated three candidates to the Legislature: Thirteenth Circuit Judge John C. Few, and Court of Appeals Judges Daniel Pieper and Paul Short. [2] After the other two candidates withdrew from the race, Few was elected as Chief Judge. [3]
