There are three seats on the Texas Supreme Court up for election in 2010. Justice Harriet O'Neill has announced that she will not seek re-election upon the expiration of her term, Justice Paul Green's term is up for a vote, and Justice Scott Brister's 2009 retirement created an opportunity for the Governor to appoint Eva Guzman to the court, who will have to run in the general election if she wishes to retain the seat. [1]
Several candidates have announced their intentions to run for the seats:
- Jeffrey Brown, judge for the Fourteenth District Court of Appeals. [2]
- Debra Lehrmann, Family Judge for Texas District 360 [3]
- James Moseley, judge for the Fifth District Court of Appeals. [4]
- Rebecca Simmons, judge for the Fourth District Court of Appeals. [5]
- Rick Strange, judge for the Eleventh District Court of Appeals. [6]
- Rose Vela, judge for the Thirteenth District Court of Appeals. [7]

Three seats on the Texas Supreme Court were up for grabs in November 2008; all three incumbents in the race won re-election.
- Chief Justice Wallace Jefferson won re-election against district court judge Jim Jordan.
- In Place 7, incumbent Dale Wainwright was challenged by newcomer Sam Houston, a Houston trial lawyer.
- Incumbent Phil Johnson won re-election, opposed by Justice Linda Yanez, a Senior Appellate justice.
In the partisan election, all three incumbents were Republicans, and all three challengers are Democrats. [8]
