Supreme Court
Justices of the New Mexico Supreme Court are elected by partisan election. All judicial vacancies are filled by the governor, chosen from a list of candidates recommended by the judicial nominating commission. The candidate appointed must then compete in a partisan election at the next general election to serve the remainder of the unexpired term. [1]
If a vacancy on the court occurs, gubernatorial appointment from a nominating commission is required.[1]
The chief justice of the court serves a two year term and is elected by the other justices. The court elects the most senior justice who has not yet held the position, according to tradition.[1]
In order to join the court, an individual must meet the following qualifications: [1]
- be the minimum age of 35;
- have 10 yrs legal practice;
- be a state resident 3 yrs.
Court of Appeals
All aspects of the New Mexico Court of Appeals are the same as the New Mexico Supreme Court.[1]
District Court
The New Mexico District Court judges are elected to terms lasting six years.[1]
The chief justice is elected to term varying by the district in choice and length of term. [1]
In order to join the court, an individual must meet the following qualifications: [1]
- be the minimum age of 35;
- have 6 yrs legal practice;
- be a state resident 3 yrs;
- be a district resident.
